Financial Factors: Intellectual Property Valuation Challenges

This column is the last in a series on the valuation of intellectual property. The series has addressed the distinction between intellectual property and intangible assets for valuation purposes; the three possible approaches to valuing any property (cost/asset approach, market approach, and income approach); the various valuation premiums and discounts applications and intellectual property infringement litigation. The final column in this series summarizes the intellectual property valuation process with emphasis on the major challenges in valuing intellectual property or negotiating licensing agreements and the importance of supportive documentation for all intellectual property valuations, particularly ones that continue to litigation.
